Terms of Service — Fractor Tractor

These Terms of Service ("Terms") govern your access to and use of Fractor Tractor, including our website at fractortractor.com, our mobile applications, and related services (collectively, the "Service"), operated by Trimultaneously LLC ("we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you may use the Service only with the involvement and consent of a parent or legal guardian. By using the Service, you represent that you meet these requirements and that any registration information you submit is accurate.

2. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at the contact address below if you suspect unauthorized use of your account. We may suspend or terminate accounts that violate these Terms.

You may delete your account at any time from within the app or by contacting us. Deletion is handled as described in our Privacy Policy.

3. Subscriptions and Purchases

The core Service is available free of charge. We offer optional paid subscriptions ("Pro") that unlock additional features.

App Store purchases: Subscriptions purchased in our iOS app are processed by Apple through your App Store account. Payment is charged at confirmation of purchase, and subscriptions renew automatically unless canceled at least 24 hours before the end of the current period. You can manage or cancel subscriptions in your device's App Store account settings.
Price changes: We may change subscription prices prospectively. Changes will not affect a period you have already paid for, and you will be notified before any renewal at a new price.
Refunds: Purchases made through the App Store are subject to Apple's refund policies.
Downgrades: If your subscription ends, you retain access to your data, but features and limits revert to the free tier.

4. Your Content

"User Content" means anything you add to the Service — including photographs, item details, descriptions, valuations, notes, comments, and profile information.

You own your content. You retain all rights in your User Content.
License to us. You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display your User Content solely to operate and improve the Service, consistent with the sharing settings you choose.
Sharing. When you make a collection public or share it with other users, the content you have chosen to share becomes visible to those users. You can change your sharing settings at any time.
Responsibility. You are solely responsible for your User Content and represent that you have the rights necessary to upload it.

5. Community Rules and Acceptable Use

We have zero tolerance for objectionable content and abusive behavior. You agree not to upload, post, share, or transmit content that:

Is unlawful, defamatory, obscene, pornographic, hateful, harassing, threatening, or discriminatory;
Depicts or exploits minors in any inappropriate manner;
Infringes any third party's intellectual property, privacy, or other rights;
Is fraudulent or deceptive, including misrepresenting the authenticity, grade, or provenance of an item;
Contains malware, spam, or unauthorized advertising;
Impersonates any person or entity.

You also agree not to scrape the Service, interfere with its operation, attempt to access other users' non-public data, or use the Service to violate any applicable law.

5.1 Reporting, Blocking, and Moderation

You can report objectionable content and block abusive users directly within the app.
We review reports promptly — generally within 24 hours — and will remove content that violates these Terms and take action against the responsible user, up to and including permanent account termination.
We may remove any content or restrict any account at our discretion to protect the Service and its users.

6. Card Values and Market Data

The Service displays market information — including listings, sale prices, and estimated values — sourced from third parties such as eBay. This information is provided for informational purposes only. We do not guarantee its accuracy, completeness, or timeliness, and it does not constitute an appraisal, a guarantee of value, or financial or investment advice. Collectible values fluctuate, and any decisions you make based on information in the Service are your own responsibility.

7. Third-Party Services

The Service integrates with and links to third-party services (such as eBay listings and sign-in providers). We are not responsible for third-party services, their content, or their terms. Your use of them is governed by their own terms and privacy policies. Fractor Tractor is not affiliated with, endorsed by, or sponsored by eBay, PSA, BGS, SGC, CGC, or any card manufacturer, league, or players' association; all trademarks belong to their respective owners.

8. Our Intellectual Property

The Service — including its software, design, text, graphics, and logos, but excluding User Content — is owned by Trimultaneously LLC or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the app on Apple-branded devices that you own or control, as permitted by the App Store terms, solely to use the Service as intended. You may not copy, modify, distribute, sell, or reverse engineer any part of the Service except as permitted by law.

9. Copyright Complaints

If you believe content on the Service infringes your copyright, send a notice to the contact address below including: identification of the work, the location of the allegedly infringing material, your contact information, a statement of good-faith belief that the use is unauthorized, and a statement, under penalty of perjury, that the information is accurate and you are authorized to act for the copyright owner. We will respond to valid notices, and we may terminate the accounts of repeat infringers.

10. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access immediately if you violate these Terms, if required by law, or if we discontinue the Service. Sections that by their nature should survive termination (including Sections 4, 6, 11, 12, and 14) will survive.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DATA — INCLUDING MARKET VALUES — WILL BE ACCURATE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRIMULTANEOUSLY LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR COLLECTIBLE VALUE, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE OR (B) FIFTY U.S. DOLLARS ($50). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

13. Indemnification

You agree to indemnify and hold harmless Trimultaneously LLC and its officers, employees, and agents from any claims, damages, and expenses (including reasonable attorneys' fees) arising from your User Content, your use of the Service, or your violation of these Terms or any third party's rights.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service will be resolved in the state or federal courts located in Los Angeles County, California, and you consent to their jurisdiction. You may also be entitled to bring claims in small claims court where you reside.

15. Apple App Store Terms

If you downloaded the app from the Apple App Store, the following additional terms apply: these Terms are between you and Trimultaneously LLC only, not Apple, and Apple is not responsible for the app or its content. Apple has no obligation to provide maintenance or support for the app. In the event the app fails to conform to an applicable warranty, you may notify Apple and Apple will refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation. Apple is not responsible for addressing any claims relating to the app, including product liability, legal compliance, or intellectual property claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not located in a country subject to a U.S. government embargo and are not on any U.S. government list of prohibited or restricted parties.

16. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last Updated" date above and, where appropriate, notify you through the Service or by email. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
